For decades, CP ran freight and passenger traffic over the CN Oakville Sub between Toronto and Hamilton Junction via a trackage right agreement. This agreement dated from the Grand Trunk Railway granting it to the CP in 1896, and also included interswitching rights to customers along the line. Some speculate this was to avoid the extra competition from a potential new railway line operated by the TH&B (CP), who were considering building their own parallel line just to the north of CN's. In any case, the new TH&B line was never built, and CP's trackage rights over this stretch lasted until 2009, and weren't renewed.
